1. The Hirer must be over 25 years of age.
2. The Hirer must ensure that everyone using the Village Hall during the period of hire understands and adheres to the Terms & Conditions.
3. The Hirer is responsible for the care of the fabric and contents of the Village Hall and will make good or pay for all damage (including accidental damage) to the premises, fixtures, fittings and contents and for the loss of contents.
4. The Hirer is to ensure that neighbours are not disturbed. Music and noise must be kept to a reasonable level. This also applies in the car park particularly during arrival and departure of invitees.
5. All noise must cease by midnight.
6. To avoid disturbance, violent or criminal behaviour, care must be taken to avoid excessive consumption of alcohol. No alcohol can be served to persons suspected of being under the age of 18. No illegal drugs may be brought on to the premises.
7. If the rental of the Village Hall is for an activity involving children, National Guidance for Child Protection in Scotland (2021) will apply.
8. The Hirer must ensure that any electrical appliances brought to the premises and used there shall be safe, in good working order and used in a manner that complies with Electricity at Work Regulations 1989.
9. The Hirer shall indemnify and keep indemnified each member of the Village Hall’s management committee and the Village Hall’s employees, volunteers, agents and invitees against the cost of repair of any damage and all claims, losses, damages and costs in respect of damage or loss of property or injury to persons arising from the use of the premises.
10. The Hirer is urged to take adequate insurance to cover the Hirer, members of the Hirer’s organisation or invitees against the Hirer’s liability under the above paragraph.
11. The Village Hall Management Committee is insured against any claims arising out of its own negligence.
12. The Hirer may access chairs and tables from the shed behind the hall and is asked to put all items away at the end of hire. Any article taken from the storeroom and/or cupboards must be replaced.
13. Notices can only be pinned to the walls of the hall, lobby or kitchen with prior arrangement of the management committee.
14. All breakages are to be reported and a charge will be made for their replacement. It would be appreciated if faults such as defective light bulbs were recorded in the ‘Defects Book’ kept in the lobby entrance.
15. The Hirer should ensure that all lights are turned off before leaving and that taps and electrical equipment (save the fridge) are turned off in the kitchen.
16. The Hirer must ensure that all windows and doors, including those of the storeroom and shed, are securely shut and locked before leaving. The keys should be returned to the key box.
17. The Village Hall Management Committee accepts no responsibility for items left in the building or in the storeroom. No items whatsoever are to be left in the building except by permission of the Management Committee. The storerooms are to be kept locked except when access is needed. Items of food or drink must not be kept in the store cupboards.
18. Indoor and outdoor premises must be left clean and tidy. Please see separate Cleaning Notice.
19. Vehicles are parked at owners’ risk.
20. The Hirer must report all accidents involving injury to the public to the Management Committee as soon as possible and complete the relevant section in the Village Hall’s ‘Accident Book’.
21. The Village Hall Management Committee reserves the right to cancel a booking in the event of:
- the premises being required for use as a Polling Station;
- a proposed booking considered to be a breach of licensing conditions or that unlawful activities would take place;
- the premises becoming unfit for the use intended by the Hirer;
- the premises being required as emergency shelter for victims of events such as flooding, snowstorm, fire, explosion.
22. In the event of such a cancellation, the Hirer shall be entitled to a refund of any deposit and payment already made. However, the Village Hall Management Committee shall not be liable for any direct or indirect loss or damages whatsoever incurred by the Hirer.
